Released in 2012, as part of the Year of Procurement, LGA Procurement published a suite of state-of-the-art model documents covering contracts and policies and a related Procurement Handbook to assist Councils in making the procurement process more efficient and safer.
Over time, updates have occurred - early in 2013, the Work Health and Safety Act, 2012 and the Work Health and Safety Regulations, 2012 came into effect and South Australia’s legislation became aligned with New South Wales, Queensland, Tasmania, the Australian Capital Territory, the Northern Territory and the Commonwealth. As part of its commitment to continuous improvement, LGA Procurement updated its entire suite of template documents to reflect this change in legislation.
In 2017, the documents were further updated to reflect the amendment to the Australian Consumer Law (ACL). The ACL amendment extends unfair contract protections to small business contracts, and as such may affect certain contracts entered into by councils.
Feedback from Council procurement practitioners, and LGA Procurement specialists, is more in respect of the range of documentation – and how Councils would like to use the templates. We have received requests for greater documentation for construction and works arrangements, which we are keen to explore.
The aim of the Working Group, is to review the current contract structure and documents which comprise:
- Agreements for Purchase of Goods (one off, continuing, panel continuing)
- Minor Works Agreement
- Professional Services Agreements (one off, continuing, panel continuing)
- Purchase Orders (goods and works)
